ON MEASURES TO IMPLEMENT THE LAW OF ST. PETERSBURG
"ON A PLAQUE IN ST.-PETERSBURG"

(as amended. Decree of the Government of St. Petersburg
from 28.08.2013 N 625)



 

In order to implement Icon Law of St. Petersburg from 09.11.2011 N 706-131 "On the plaques in Saint-Petersburg" The Government of Saint-Peters (39.0 KB) decides:

1. Create a council for memorial plaques under the Government of St. Petersburg in the composition according to the appendix N 1.
2. To approve:
2.1. Regulations on the Board of memorial plaques at the Government of St. Petersburg.
2.2. The procedure for monitoring the proposals and decided to install plaques in St. Petersburg, according to the appendix N 2.
2.3. To install, preservation and removal of plaques in St. Petersburg, according to the appendix N 3.
3. Amend the Regulations on the Committee on Culture, approved by Decree of the Government of St. Petersburg of 25.05.2004 N 806 "On the Committee on culture," adding his point 3.30-2 to read as follows:
"3.30-2. To carry out certain functions in the field of installation and removal of plaques in St. Petersburg in the order established by the Government of St. Petersburg, including:
to monitor proposals for the installation of plaques in St. Petersburg;
take decisions on the dismantling of memorial plaques in St. Petersburg. "
4. Amend the Regulation on the Administration of St. Petersburg district, approved by Decree of the Government of St. Petersburg of 26.08.2008 N 1078 "On the administrations of districts of St. Petersburg" (hereinafter - Regulations), outlining the provisions of paragraph 3.6.40 as follows:
"3.6.40. Carry out in the order established by the Government of St. Petersburg, the individual functions in the field of installation, removal and preservation of memorial plaques in St. Petersburg, including making decisions about installing memorial plaques in St. Petersburg in cases provided by the Government St. Petersburg ".
5. To recognize as invalid:
Resolution of the Government of St. Petersburg of 17.01.2005 N 2 "On a plaque in St. Petersburg";
Resolution of the Government of St. Petersburg of 03.08.2006 N 950 "On Amending Resolution of the Government of St. Petersburg from 17.01.2005 N 2";
Resolution of the Government of St. Petersburg of 22.03.2010 N 237 "On Amending Resolution of the Government of St. Petersburg from 17.01.2005 N 2".

POSITION
ON THE COUNCIL FOR A MEMORIAL PLAQUE
GOVERNMENT OF SAINT PETERSBURG

 

General Provisions
1. Council on plaques at the Government of St. Petersburg (hereinafter - the Council) was established for the purpose of preparing and making decisions about installing memorial plaques in St. Petersburg.
1.2. The Council is a permanent collegial advisory body under the Government of St. Petersburg.
1.3. The Council's decisions are advisory in nature.
14. In its activities the Council is guided by the laws of the Russian Federation, St. Petersburg, as well as these Regulations.

2. The purpose and objectives of the Council

2.1. The purpose of the Board is to assist the executive authorities of St. Petersburg in the preparation and decision-making about how to install plaques in St. Petersburg.
2.2. The objectives of the Council are considering proposals of the federal authorities, state authorities of St. Petersburg and other regions of the Russian Federation, local authorities in St Petersburg, as well as legal entities about installing memorial plaques in St. Petersburg and decided to install or refusal installation plaques in accordance with the requirements stipulated by the Law of St. Petersburg from 09.11.2011 N 706-131 "On the plaque in St. Petersburg" (hereinafter - the Law).

3. Powers of the Council

In order to achieve the objectives and tasks set out in section 2 of this Regulation, the Council has the following powers:
3.1. Prepare proposals for the development of legal acts of the Government of St. Petersburg in the areas of installation of plaques in St. Petersburg.
3.2. Require the executive authorities of St. Petersburg, and other state bodies of St. Petersburg, territorial bodies of federal executive authorities, local self-government in St. Petersburg and corporate information, documents and materials necessary for solving the problems of the Council.
3.3. Invited to attend meetings of the Board of Officials of territorial bodies of federal executive bodies, executive bodies of St. Petersburg, and other state bodies of St. Petersburg, local authorities in Saint Petersburg and public associations and other organizations on issues related to the competence of the Board.
3.4. Aiming at the invitation of the executive authorities of St. Petersburg Council representatives to participate in events held by the executive authorities of St. Petersburg on matters within the competence of the Council.
3.5. To conduct public discussions, public hearings, conferences, seminars, round tables and other events to discuss issues related to the competence of the Board.
3.6. To involve experts from the Council of scientists and experts in various fields related to the issues of studying the biographies of eminent personalities, whose life and work were associated with St. Petersburg, or fields related to the study of the historical events that took place in St. Petersburg.

4. Organization of Board

4.1. The Council consists of Chairman of the Board, Board members, including representatives of the Committee for State Control, Use and Protection of Monuments of History and Culture (hereinafter - KGIOP) and the Committee on Urban Planning and Architecture (hereinafter - CCA), and the Secretary of the Board.
4.2. The Council is headed by Chairman of the Board, which administers the Council, the decision of the Council of current issues, and coordinating the work of its members.
In the absence of the Chairman of the Board of its functions are performed by one of the members of the Board on behalf of the Chairman of the Board.
4.3. Organization of the Board of The Secretary of the Council, which has the following functions:
inform the members of the Council and invited to the meeting of the officials of the government of St. Petersburg, legal and physical persons of the date, time, agenda and venue of the meeting of the Board, including the informed members of the Council, which is representative KGIOP, the need to submit KGIOP Council conclusion referred to in paragraph 4.6 of this Regulation;
directs the members of the Board, the federal state authorities, state authorities of St. Petersburg and other regions of the Russian Federation, local authorities in St. Petersburg and interested organizations and citizens of the documents and materials on the activities of the Council;
leads clerical and prepares the minutes of meetings of the Council.
4.4. The Council meets at least twice a year.
4.5. Meetings of the Board are considered eligible on condition that more than half of the total number of members of the Board.
4.6. If prompted to install a plaque on the facade of the building, a member of the Council, a representative KGIOP, submit to the Council the conclusion KGIOP (non-compliance) installation of a memorial plaque with the Federal Law "On Objects of Cultural Heritage (historical and cultural monuments) of the Russian Federation" as well as the requirements of paragraph 3 of Article 3 of the Act.
The above conclusion is signed by the head or deputy head of KGIOP.
4.7. Council meeting in the protocol indicating the date and place of the meeting, the content of the issues, information about attendance of Board members and the persons invited to the meeting of the Council of detention KGIOP (if prompted to install a plaque on the facade of the building), and other data related to the subject question, as well as information on decisions taken.
The protocol signed by the Chairman of the Council and Secretary of the Board.
4.8. The Council's decisions are taken by simple majority vote. Take part in the voting Chairman of the Board and Board members.
In the case of an equality of votes, the vote of the Chairman of the Board.
4.9. Extracts from the minutes of the meetings of the Council in two copies in 15 days sent to the Committee on Culture, and if prompted to install a plaque in the room either facing the courtyard facade of the building, also in the administration of the district of St. Petersburg.
4.10. If prompted to install a plaque on the facade of the building, to extract from the minutes of the meeting of the Council to sign the attached copy KGIOP.
4.11. The meetings of the Board in consultation with the Chairman of the Council may participate in an advisory capacity are not members of the Council invited the representatives of the government of St. Petersburg, territorial bodies of federal executive authorities, local self-government in St. Petersburg, associations and public figures.
4.12. The Council, in accordance with the tasks assigned to it can create from among its members, as well as among the involvement of the experts from outside its membership, expert advisory groups.
4.13. Other questions of the organization of the Council are governed by the regulations of the Council, adopted at the Council meeting.
4.14. Organizational and technical support of the Council by the Committee on Culture.

ORDER
MONITORING OF OFFERS AND DECISION-MAKING
INSTALLATION PLAQUE IN SAINT PETERSBURG

 

1. This Procedure defines the procedure for monitoring the proposals on installing memorial plaques in St. Petersburg (hereinafter - monitoring) and decided to install plaques in St. Petersburg.
2. Monitoring is carried out by the Culture Committee (hereinafter - Committee) twice a year in order to determine the grounds for the installation of plaques in St. Petersburg.
3. Information on the monitoring and calls for proposals on installing memorial plaques in St. Petersburg (hereinafter - Offer) is located on the official website of the Committee in the information and telecommunications on the Internet.
4. The Committee shall monitor the following dates:
4.1. From July 1 to September 1 this year - on the proposals received from January 1 to June 30 this year.
4.2. From 1 January to 1 March of the year following the year of receipt of the proposals - the proposals received from 1 July to 31 December this year.
5. If the monitoring Committee shall consider the proposals for compliance with the requirements set out in paragraph 2 of Article 4 of the Law of St. Petersburg from 09.11.2011 N 706-131 "On the plaque in St. Petersburg" (hereinafter - the Law).
6. Within one month from the date of the end of the monitoring referred to in paragraph 4 of this Order, the Committee:
6.1. In the case of matching proposal fulfills the requirements set out in paragraph 2 of Article 4 of the Act, in writing, notify the federal authorities, state authorities of St. Petersburg and other regions of the Russian Federation, local governments intracity municipalities of Saint-Petersburg and legal entities that have submitted a proposal (hereinafter - the initiators) to transfer proposals to the Council on the memorial plaques at the Government of St. Petersburg (hereinafter - the Council) and transmits these proposals to the Council.
6.2. In case of discrepancy proposal fulfills the requirements set out in paragraph 2 of Article 4 of the Act, in writing, initiator of non-compliance offer the specified requirements.
7. Proposals received by the Committee repeatedly, which was previously the Council decided to refuse the installation of a memorial plaque, are not transmitted to the Board for five years, as the Committee within one month in writing notify the initiator.
8. Proposals to the Committee to the Council on the monitoring results are considered by the Board in accordance with the Regulations of the Board.
Extracts from the minutes of the meetings of the Council are directed in accordance with the Regulations on the Board of the Committee, and if prompted to install a plaque on the facade facing the courtyard of the building, the room, and also the administration of the district of St. Petersburg.
9. The Committee within one month after receipt of the statement of the minutes of the Board directs the proponent written notice of the decision taken by the Council, with the application of said extracts.
10. Adoption of the Council decision on the installation of a memorial plaque on the facade of the building, overlooking the thoroughfare (avenue, boulevard, lane, avenue, square, street, highway, etc.), Is the basis for the preparation of a draft legal act of the Government of St. Petersburg on the installation of a memorial plaque .
Preparation and approval of the draft legal act of the Government of St. Petersburg on the installation of a memorial plaque by the Committee in accordance with the procedure defined by the Regulations of the Government of St. Petersburg, approved by the Government of St. Petersburg of 16.12.2003 N 100, within one month after receipt of an extract from the minutes of the Board the application conclusions of the Committee for State Control, Use and Protection of Historical and Cultural Monuments (hereinafter - KGIOP) specified in paragraph 4.6 of the Regulations of the Board (hereinafter - the conclusion KGIOP).
The decision of the Government of St. Petersburg on the installation of a memorial plaque was adopted taking into account the decision taken by the Council, and the conclusion KGIOP subject to compliance with the installation of a memorial plaque with the requirements stipulated by the current legislation.
If the installation of a memorial plaque does not meet the requirements of the current legislation, the decision to install a memorial plaque is not accepted, as the Committee within one month after receipt of an extract from the minutes of the Board to enter into application KGIOP notify the initiator.
11. The draft legal acts of the Government of St. Petersburg on installing memorial plaques in the prescribed manner to be agreed with the Committee on Urban Planning and Architecture, KGIOP, the district administration of St. Petersburg, which is established in the territory of a memorial plaque.
To draft legal acts of the Government of St. Petersburg on installing plaques attached extract from the minutes of meetings of the Board and a copy of the conclusion KGIOP.
12. Adoption of the Council decision on the installation of a memorial plaque on the facade facing the courtyard of the building, the room is the basis for the preparation of a legal act of the district administration of St. Petersburg about the installation of a memorial plaque.
Preparation of a legal act of the district administration of St. Petersburg is carried out within one month after receipt of an extract from the minutes of the Board to enter into application KGIOP (if prompted to install a plaque on the facade of the building).
The decision of the district administration of St. Petersburg about the installation of a memorial plaque was adopted taking into account the decision taken by the Council, and the conclusion KGIOP (if prompted to install a plaque on the facade of the building), subject to compliance with the installation of a memorial plaque with the requirements stipulated by the current legislation.
If the installation of a memorial plaque does not meet the requirements of the current legislation, the decision to install a memorial plaque is not accepted, as the district administration of St. Petersburg within one month after receipt of the statement of the minutes of the Board shall notify the initiator.
13. Within two weeks after the decision to install a memorial plaque:
13.1. The Committee shall send a copy of the legal act of the Government of St. Petersburg to the initiator.
13.2. The district administration of St. Petersburg sends a copy of its legal instrument to the initiator.
14. Adoption of the Council decision on the installation of a memorial plaque in exceptional cases provided for in the third paragraph of paragraph 2 of Article 1 of the Law, is the basis for the preparation and direction to the Governor of St. Petersburg Project presentation of the Governor of St. Petersburg Legislative Assembly of St. Petersburg on the installation of a memorial plaque .
Preparation of the draft submission made by the Committee within one month after receipt of an extract from the minutes of the Board to enter into application KGIOP.
15. The Committee within two weeks after receipt of the decision of the Legislative Assembly of St. Petersburg will notify the initiator of the decision taken by the Legislative Assembly of St. Petersburg.
16. Preparation of a draft legal act of the Government of St. Petersburg on the installation of a memorial plaque in St. Petersburg in exceptional cases provided for in the third paragraph of paragraph 2 of Article 1 of the Act, the Committee is carried out in the presence of a recommendatory decision about the installation of a memorial plaque, adopted by the Legislative Assembly of Saint Petersburg the presentation of the Governor of St. Petersburg, in the manner prescribed in paragraphs 10 and 11 of this Order, within one month after receipt of the decision of the Legislative Assembly of St. Petersburg.

 

APPENDIX N 3

ORDER INSTALLATION,
SECURING AND DISMANTLING PLAQUES
IN SAINT PETERSBURG

 

1. This procedure has been developed in accordance with the Law of St. Petersburg from 09.11.2011 N 706-131 "On the plaque in St. Petersburg" and regulates the installation, maintenance of safety and the dismantling of memorial plaques in St. Petersburg.
2. Installation plaques on the facades of buildings, facing the passage (alley, boulevard, lane, avenue, square, street, highway, etc.), St. Petersburg, made on the basis of legal acts of the Government of St. Petersburg.
3. Installation plaques on the facade facing the courtyard of the building, the room is done on the basis of legal acts of the district administration of St. Petersburg.
4. Installation plaques in St. Petersburg by federal state authorities, state authorities of St. Petersburg and other regions of the Russian Federation, local authorities intracity municipalities of Saint-Petersburg and legal entities which have sent the proposal to install a memorial plaque (hereinafter - Customer ) in accordance with the draft design of a memorial plaque (hereinafter - the preliminary design), coordinated by the Committee on Urban Planning and Architecture (hereinafter - KGA).
5. In order to harmonize the draft design of the customer sends a CCA statement agreeing conceptual design (hereinafter - the application), to which are attached the following information materials:
5.1. Color photographs of the installation of a memorial plaque, made not later than 15 days before the date of submission of the application, the format is not smaller than 10 x 15 cm.
5.2. Draft design in color in two copies, each numbered and stitched to form. The structure of the draft design includes front and side views, views and sections (in the case of three-dimensional parts and components), data on the size, materials, surface treatments plaque compositional and graphic solution of the information field of the memorial plaque.
5.3. Computer installation of a memorial plaque on the image size is not smaller than 10 x 15 cm in two copies, each numbered and stitched to form.
6. Consideration of applications and information materials is carried out in the CAC 15 days from the date of their receipt.
7. Upon review of the application and information materials CCA provides approval of conceptual design, on which a note on conceptual design, or submit a written reasoned refusal to agree.
8. CCA fails to agree on the draft design when presented information from the materials that the draft design does not correspond to the decision on the installation of a memorial plaque and (or) the general requirements for the placement of additional components and devices facades of buildings set out in paragraph 4-1.3. 2 Rules of the maintenance and repair of facades of buildings and structures, approved by the Government of St. Petersburg 14.09.2006 N 1135.
9. Re-direction of the application and information materials in the CCA, as well as their consideration CCA carried out in the manner prescribed in paragraphs 5 - 8 of this Order.
10. Save plaques in St. Petersburg provided by their owners or their authorized representatives.
Monitoring the safety of plaques set in St. Petersburg, according to the order on the facades of buildings, carries out the administration of the district of St. Petersburg, on the territory of which a memorial plaque.
11. The district administration of St. Petersburg holds annual inspection of the facades of buildings in order to:
establish the existence of the district of St. Petersburg plaques set in the absence of a legal instrument for the installation of a memorial plaque;
verify the installation of commemorative plaques to their original location after repair and (or) restoration of buildings (premises), or plaques.
12. In the case of plaques set in the absence of a legal instrument for the installation of a memorial plaque, the district administration of St. Petersburg before the Committee on Culture (hereinafter - the Committee):
the act of identifying the plaque installed in the absence of a legal act;
photographic images of the plaque installed in the absence of a legal act.
13. Removing the plaque installed in the absence of a legal act on the basis of a legal act of the Committee. The basis for the preparation of a draft legal act on the dismantling of the memorial plaque are the documents submitted to the Committee of Administration of the District of St. Petersburg in accordance with paragraph 12 of this Order.
14. Dismantling of the memorial plaque for the period of repair and (or) restoration of the building, the facade of which is a memorial plaque, or a room where a memorial plaque, made by a company conducting the repair and (or) restoration, preliminary notice in writing to the administration of the district of St. Petersburg on purpose, date, period, dismantling and storage location of a memorial plaque.
Upon completion of the repair and (or) restoration of the building or premises plaque set specified entity in its place without adoption of a legal instrument for the installation of a memorial plaque with prior notice in writing to the administration of the district of St. Petersburg.
15. Dismantling of the memorial plaque for the period of repair and (or) restoration of the memorial plaque by the customer or entity conducting the repair and (or) restoration of a memorial plaque, with advance notice in writing to the administration of the district of St. Petersburg on purpose , date, period, dismantling and storage location of a memorial plaque.
Upon completion of the repair and (or) restoration of the memorial plaque memorial plaque installed by the customer or legal entity referred to in its place without adoption of a legal instrument for the installation of a memorial plaque with prior notice in writing to the administration of the district of St. Petersburg.
